Permanent Establishment (PE) issues concern the determination of whether a non-resident entity or individual has a sufficient business presence in a foreign jurisdiction to trigger local tax obligations. In the context of decentralized finance (DeFi) and crypto, the distributed nature of operations complicates traditional PE definitions. Nodes, validators, or protocol contributors may inadvertently create a PE in various jurisdictions, even without physical presence. This uncertainty creates significant compliance risk for participants and protocols. It challenges existing international tax norms.
